1. Definitions

• “Bolcho”, “we”, “us”, “our” — Bolcho AI, a product of Neobound, 804, Tower-19, Plot No. 9, Unitech Habitat, Sec Pi-2, Alpha Greater Noida, Gautam Buddha Nagar, Noida, Uttar Pradesh, India – 201310.
• “Customer”, “you” — the individual or entity that registers for or uses the Service.
• “Assistant” — an AI voice or chat agent configured by you on the Service.
• “End-User” — any person who interacts with your Assistant (e.g. a caller or chatter).
• “Customer Data” — content and data you or your End-Users submit to or generate through the Service.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration details, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use.

3. The Service

Bolcho provides software to build, deploy, and operate AI Assistants that can place and receive phone calls, answer chats, use knowledge bases, capture leads, and produce transcripts and analytics. Features, limits, and supported integrations may change over time. We may use third-party providers (cloud, telephony carriers, and AI model providers) to deliver the Service.

4. Acceptable use

You agree not to use the Service to, and not to permit any End-User or third party to:

• Violate any law, regulation, or third-party right, including telecom, privacy, consumer-protection, and anti-spam laws.
• Place unsolicited, deceptive, fraudulent, or unlawful calls or messages, or engage in vishing, phishing, or scams.
• Impersonate any person or entity, or misrepresent that an interaction is with a human when it is with an AI where disclosure is required.
• Transmit malware, attempt to gain unauthorised access, disrupt, overload, or reverse-engineer the Service.
• Generate or distribute content that is illegal, harmful, harassing, hateful, or infringing.
• Use the Service for emergency services or life-safety communications; the Service is not a substitute for emergency calling.

We may investigate suspected violations and suspend or terminate access to protect the Service and its users.

5. Telephony, calls & consent

You are solely responsible for the lawfulness of the calls and messages you send or receive through the Service, including obtaining any required consent and providing any required disclosures. In India, this includes compliance with TRAI regulations, DLT registration where applicable, and Do-Not-Disturb (DND) requirements. Where you enable call recording or transcription, you are responsible for obtaining any legally required notice and consent from all parties before recording.

6. AI-generated content

Assistant outputs are generated by artificial intelligence and may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing outputs and for how you configure and deploy your Assistants. Bolcho does not warrant that outputs are correct or fit for any particular purpose, and outputs do not constitute professional (legal, medical, financial, or other) advice.

7. Customer Data & responsibilities

As between you and Bolcho, you own your Customer Data. You grant us a limited licence to host, process, and transmit it solely to provide and support the Service. You represent that you have all rights and consents needed for us to process Customer Data (including End-User Data) as contemplated by these Terms and our Privacy Policy. You are the Data Fiduciary/Controller for End-User Data; Bolcho processes it as your processor on your instructions.

8. Fees, credits & billing

• Paid features are billed on a prepaid-credit and/or subscription basis as described at purchase. Usage (e.g. call minutes, AI processing) draws down credits.
• Fees are exclusive of applicable taxes (including GST), which you are responsible for.
• Except as required by law, payments and credits are non-refundable once consumed.
• We may change pricing prospectively with notice. Non-payment may result in suspension.

9. Third-party services

The Service integrates third-party providers and may link to third-party products. Your use of those services is governed by their terms, and Bolcho is not responsible for them. Provider availability or changes may affect the Service.

10. Intellectual property

The Service, including its software, design, and trademarks (including “Bolcho”), is owned by us or our licensors and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service; no other rights are granted. You may provide feedback, which we may use without obligation to you.

11. Confidentiality

Each party may access the other’s non-public information. The receiving party will use it only to perform under these Terms and protect it with reasonable care, except where disclosure is required by law.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI outputs will be accurate.

13. Limitation of liability

To the maximum extent permitted by law, Bolcho and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the three (3) months preceding the event giving rise to the claim.

14. Indemnification

You will indemnify and hold harmless Bolcho and its affiliates from claims, damages, and expenses arising out of your Customer Data, your use of the Service, your calls or messages, or your breach of these Terms or of applicable law (including telecom and privacy laws).

15. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or fail to pay. On termination, your right to use the Service ends; provisions that by their nature should survive (e.g. IP, confidentiality, disclaimers, liability, indemnity, governing law) will survive. Data handling on termination is described in the Privacy Policy.

16. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to any applicable mandatory law, the courts at Gautam Buddha Nagar, Uttar Pradesh, India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance.
